    The $500 cost above the "Premium" Listing Plan, just about always comes back to you several times over in the form of a higher negotiated sales price, lower repair costs after inspection (often a hurdle sellers don't expect, and where they tend to give away more than they need to), and avoidance of small overlooked items that could easily cost more than $500. In addition, you get the peace of mind that comes with knowing that a professional is representing you and looking out for your best interests.

    We negotiate contracts every day. We know when to push, when to let up, and what points shouldn't matter. We know the warning signs in an offer that deserve closer scrutiny. Sellers often get into contracts that never close because they aren't used to seeing the red flags in an offer.

    Sellers have a tendency to drop price too quickly in the midst of negotiations out of fear of losing the deal, and other times cling to a price or certain terms they are unlikely to get any buyer to agree to. Seller emotions can also get in the way.

    Another problem is that over half of all agents are not very competent. Unlike CPA's, doctors or lawyers, there is no college degree required to be a real estate agent. Any high school dropout can become a Realtor if he takes a few courses and passes the State & national licensing exams. Incompetent agents lead to problems, wasted time and transactions that never close.

    Some agents can be difficult to deal with and downright aggravating, or just want to give you a hard time.

    BUYER'S AGENT COMMISSION: (BAC): All listings are subject to the policies of the MLS. The MLS requires that all advertisements on their system offer a buyer-agent commission, ranging from 2% to 4%.
    We suggest 3% to be competetive in todays market.
    However, the amount of commission you offer a buyer's agent is up to you.
    (Anti-trust laws prohibit the MLS from specifying how much commission you should offer). Our company takes no part of the buyer-agent commission.
    If you find your own "unrepresented buyer" (a buyer that does have an agent or desire to use an buyers agent),
    then you will not pay a buyer-agent commission.


    TRANSACTION FEE:
    The State of Utah passed Senate Bill 56. on May 1st 2005. This legislation mandates that ALL brokerages provide certain services to their clients, including the availability of a licensed agent to provide advice and consultation on offers, counter-offers, escrow, settlement and closing during business hours. Furthermore, brokerages are required to maintain a copy of the seller's closed transaction paperwork for a period of three calendar years. Due to these state imposed responsibilites flat fee companies charge $90 or more, due at closing)

You may choose a different title company, but you must name both the tile company & escrow officer on the listing agreement.
    The State of Utah and the MLS prohibit "By Owner" signs on any property listed on the MLS. Notice: If a "By Owner" sign is spotted by MLS staff or another REALTOR®, your property will be immediately removed from the MLS system without notice, and revoked for a period of one year.
    Any "For-Sale-By-Owner" type sign is a mistake
    1) For-Sale-By-Owner signs attract 3 kinds of people that most sellers don't want to hear from:

    Real estate agents who just got their license and have no clients and no experience. Their broker tells them to go get some listings, and start by calling all the For-Sale-By-Owner signs.
    Buyers who have bad credit and no money, and are looking for a seller who will owner finance or do a lease-option.
    Recent real estate seminar graduates / wannabe-millionaires who are taught that if they call enough For-Sale-By-Owner signs, they will eventually find a seller dumb enough to sign over his house for no money down.

    2) Buyers who are ready to buy now want to see a wide selection of houses so they can compare and make the best choice.
    Even buyers who hate Realtors usually end up using one to buy a house. Buyers figure the seller is paying the commission anyway, and they will find the right house quicker with a Realtor. Pursuing For-Sale-By-Owner houses one-at-a-time is time-consuming.

    3) Anyone who has taken the time to call enough For-Sale-By-Owner houses will eventually experience these statistics: Half of them are significantly over-priced, and one out of ten is a seller who is either eccentric or downright nuts. After having these experiences, many qualified buyers tend to perceive For-Sale-By-Owner houses as a waste of time, and pursue houses that are MLS listed.

    4) When agents set up showings for your home in MLS, they know that their commission is guaranteed by the listing agent if their buyer buys the home. When agents show up and see a "For-Sale-By-Owner" yard sign, they may skip the showing and drive off. They may assume that either the home is no longer in MLS, or they are afraid the buyer will cut them out and deal direct with the seller. Either way, they lose their commission. This explains why "drive offs" are common when there is a For-Sale-By-Owner sign, while the seller is wondering why agents set up showings and never show up.

    When a buyer calls us, we refer them to the seller and do not attempt to show the house to make a commission. We briefly explain to buyers what we do so they don't get confused, since we do the opposite of what other Realtors do. We don't mind taking the calls because we sometimes get buyers who list their homes with us after they understand how we work.
